Smashy Club Terms

1. Who Can Join

Membership in the Smashy Club is:

• free;
• open to any adult individual residing in Algeria or having an active Algerian mobile phone line;
• personal: one account per phone number, one phone number per person.

The membership of a minor is only possible with the agreement of a parent or guardian.

LS SMASHY BURGER reserves the right to refuse a membership or close an account in the event of proven fraud, abusive behavior, or violation of these terms.

2. How to Sign Up

Registration is done online, in a few seconds, at:

smashyburgers.com/carte

The registration form only asks for:

• your first name;
• your last name;
• your Algerian mobile phone number;
• your consent (checkbox) to receive marketing communications — optional, no impact on point accumulation.

Once registered, you receive your Smashy Club card in digital format:

• Apple Wallet (iPhone);
• Google Wallet (Android);
• Web Card (link to save on your phone's home screen, usable on any device).

There is no physical version of the card. The program is 100% digital.

3. Point Accumulation — Rules

3.1 The Golden Rule

1 DZD spent = 1 Smashy point.

Points accumulate automatically with each eligible purchase made at the cash register, as soon as you give your Smashy Club phone number at payment (or the cashier scans your digital card).

3.2 Eligible Purchases

Eligible for points:

• burgers, menus, sides, drinks, cookies, and all food items from Smashy Burgers sold at the restaurant;

3.3 Non-Eligible Purchases

Do NOT generate points:

• eWallet top-ups (see §5);
• Smashy orders already paid through other channels where your identity is not communicated;
• orders placed via third-party platforms (Yassir Express, etc.) as long as these platforms are not integrated into the program.

3.4 Customer Identification

The allocation of points requires that your phone number be given at the cash register before payment. No retroactive allocation will be possible if you forget to identify yourself.

4. Rewards — Rules

4.1 Free Smash Burger

1,000 points = 1 free Smash Burger.

As soon as your balance reaches 1,000 points, the reward is automatically available and appears on your card. You can unlock it at the cash register during your next visit by requesting the reward redemption.

4.2 Reward Usage Conditions

• A Smash Burger reward cannot be exchanged for money, transferred to another customer, or combined with another reward or promotion on the same product (unless otherwise stated).
• LS SMASHY BURGER reserves the right to occasionally introduce new rewards (intermediate tiers, anniversary offers, limited operations) which will be announced on the site, on the Smashy Club card, and/or on our social networks.

4.3 Point Expiration

Points expire 12 months after the last transaction crediting or debiting your Smashy Club account.

Concretely, as long as you use your card (purchase or reward) at least once a year, your points remain active. Conversely, an account that remains inactive for 12 consecutive months has its points balance reset to zero.

5. Smashy eWallet — Rules

The Smashy eWallet is a service complementary to the Smashy Club program. It allows you to prepay a balance usable as a means of payment at Smashy Burgers, with a bonus offered on each top-up.

5.1 Top-ups and Bonuses

The amounts and bonuses available at shop opening are:

Top-ups are made at the cash register only, by any accepted means of payment (cash, CIB card, Edahabia card, Yassir voucher).

5.2 Balance Usage

The eWallet balance is usable:

• only at Smashy Burgers (one single shop at opening — El Biar);
• as primary or complementary means of payment for a food purchase;
• in addition to loyalty point accumulation (eWallet payments earn points on their actual consumption value, excluding top-up).

5.3 What the eWallet Is Not

The Smashy eWallet is a closed-loop wallet. It cannot:

• be refunded for money (cash, transfer, etc.);
• be transferred to another customer;
• be used outside Smashy points of sale;
• be used to buy new eWallet credits;
• be used to redeem loyalty points.

In case of refund request for a recent top-up (e.g., entry error), the decision belongs exclusively to LS SMASHY BURGER. No refund obligation is guaranteed once the transaction is validated.

5.4 Balance Expiration (Breakage)

An eWallet balance inactive for 24 consecutive months is considered abandoned: it is permanently closed and the corresponding balance is no longer usable.

Any transaction (top-up or use) resets the counter to 0.

5.5 Lost or Changed Phone

Your eWallet balance is linked to your Smashy Club phone number. In case of:

• number change: report it by email to contact@smashyburgers.com for manual transfer;
• phone loss / theft: your balance remains secure, it is only usable with your Smashy Club number identified at the cash register.

6. Modification, Suspension, or Closure of the Program

LS SMASHY BURGER reserves the right:

• to modify these terms (accumulation rates, reward tiers, validity period, eWallet conditions) at any time, informing members via the site smashyburgers.com/club at least 30 days before the changes take effect;
• to temporarily suspend the program for maintenance or exceptional operation;
• to permanently close the program with a minimum notice of 60 days, allowing members to use their existing points and eWallet balances before closure.

In case of program closure:

• acquired points remain usable until the announced closure date;
• eWallet balances remain usable until the announced closure date and do not give rise to refund in case of non-use (closed-loop).

7. Customer Support

For any question, dispute, or claim regarding your Smashy Club card or your eWallet:

• by email: contact@smashyburgers.com (response within 3 business days);
• in-store: with the present manager;
• by phone: [PENDING — to be added upon shop line activation].

In case of disagreement on the allocation of a transaction (points not credited, incorrect balance, etc.), LS SMASHY BURGER undertakes to study the request and respond within a reasonable time. The proof of purchase (receipt) facilitates the processing.

8. Personal Data

As part of the Smashy Club, LS SMASHY BURGER processes your personal data in accordance with Law No. 18-07 of 10 June 2018 on the protection of personal data.

8.1 Collected Data

• Strictly necessary: first name, last name, mobile phone number;
• Optional: consent to marketing communications;
• Generated by your activity: transaction history (date, amount, payment method, products purchased), point balance, eWallet balance.

8.2 Purposes

Your data is used only to:

• create and manage your Smashy Club account;
• identify you at the cash register and credit your points / use your eWallet;
• keep you informed of news, offers, and rewards (only if you have consented);
• establish our internal management statistics (revenue, visit frequency, average basket) — in an anonymized or aggregated form for these statistics.

8.3 Retention

Your data is retained as long as your Smashy Club account is active. In case of account closure (prolonged inactivity, deletion request), it is deleted within 30 days, except for accounting legal retention obligation applicable to LS SMASHY BURGER.

8.4 Your Rights

In accordance with law 18-07, you permanently have the following rights on your data:

• access: consult the data held about you;
• rectification: correct inaccurate data;
• opposition: refuse processing for marketing purposes (without impact on the management of your card);
• deletion: request the closure of your account and the deletion of your data.

To exercise these rights, write to contact@smashyburgers.com specifying your Smashy Club phone number. Response within 30 days maximum.

8.5 Sharing with Third Parties

Your data is never transferred, rented, or sold to third parties for commercial purposes.

It may be shared:

• with our technical service providers (Odoo hosting, Vercel, Cloudflare) strictly within the framework of the technical provision of the service;
• with competent authorities upon legal request (judicial requisition, tax audit, etc.).

9. Modification of the Terms

LS SMASHY BURGER reserves the right to modify these terms at any time.

Modifications are:

• published on smashyburgers.com/club;
• applicable 30 days after their publication unless they are favorable to you (applicable immediately).

Continued use of your Smashy Club card beyond this date constitutes acceptance of the new rules. If you refuse the modifications, you can at any time request the closure of your account by email to contact@smashyburgers.com.

10. Applicable Law and Jurisdiction

These terms are governed by Algerian law.

In case of dispute, and failing prior amicable settlement, the courts of Algiers alone have jurisdiction.
